The Board of Education voted this evening to commence any appropriate legal action necessary to challenge Commissioner Rosa’s decision regarding the district’s nickname and imagery including, but not limited to, filing an appeal pursuant to Article 78 of the CPLR in Supreme Court, Albany County.
The Board disagrees with Commissioner Rosa’s Decision No. 18058 and finds her determination and orders as being beyond her lawful authority and that her decision is arbitrary and capricious. The Board looks forward to the opportunity for the district to present its case in the legal proceedings.
